Studio 406 Sweepstakes ("Sweepstakes") is offered and open only to legal residents of the United States and District of Columbia who are 18 years or older with legitimate credentials in the film industry in a production capacity, as determined by the Montana Department of Commerce in its sole discretion. Employees, officers and directors of the Montana Department of Commerce (sponsor), and their affiliates, prize suppliers, advertising and promotion agency, and the immediate family members (defined as current spouse as well as siblings, children and parents and their respective spouses; regardless of where they live) or members of the same households (whether related or not) of such employees/officers/directors are not eligible. Void where prohibited by law.

1. TO ENTER: ON-LINE ENTRY. Between October 15, 2009 at 12:01 a.m. Mountain Time ("MT") and 11:59 p.m. MT on January 31, 2010. Go to www.scout406.com to register to win. On the page titled “Entry Form”, complete and submit an on-line official entry form, with your name, address, business, title, e-mail address and daytime telephone number. All on-line entries must be received by 11:59 p.m. MT on January 31, 2010. No other form of Internet/email entry will be accepted. Limit one entry of any kind per person or e-mail address. Any person who attempts to participate with multiple e-mail and/or street addresses, under multiple identities or uses any device or artifice to enter multiple times will be disqualified. In case of dispute, on-line entry will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. No responsibility is assumed by Sponsor for lost, late, damaged, incomplete, stolen, misdirected, illegible entries/e-mail; or for any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions/failures; or for garbled, jumbled or corrupt transmissions; or for other technical error of any kind. Once submitted, entries become sole property of Sponsor and will not be returned.

2. WINNER SELECTION: Winners will be selected in a random drawing from among all eligible entries received. The drawing will be conducted by the Montana Department of Commerce the week of February 15, 2010. By participating, entrant agrees to these Official Rules and the decisions of the Sponsor, which are final and binding in all respects.

3. WINNER NOTIFICATION: Potential winner will be notified by mail, email and/or telephone, at Sponsor's discretion, using the information provided on the potential winner's entry form. To claim the Grand Prize, the potential winner will be required to complete and return an Affidavit of Eligibility, Release of Liability and Publicity Release (where permitted by law) (collectively, the "Affidavit") within ten (10) business days from the first day of notification. In the event: (a) potential winner cannot be reached for whatever reason after a reasonable effort has been exerted based on the information stated in the entry form, (b) of noncompliance with the above or within any of the aforesaid time periods, (c) potential winner is found to be ineligible to enter the Sweepstakes or receive the prize, (d) potential winner cannot or does not comply with the Official Rules, (e) potential winner's prize notification or Affidavit is returned as undeliverable for whatever reason, or (f) potential winner fails to fulfill the Affidavit-related obligations, the potential winner shall be disqualified from the Sweepstakes and an alternate potential winner may be selected, at Sponsor's sole discretion, from among the other eligible entries received.

4. PRIZES/ODDS: Grand Prize (1) An all-expense paid FAM trip to Montana for 4 days/3 nights for the winner and one guest. Trip consists of round-trip coach air travel for two, accommodations to be provided for winner and his/her guest, ground transportation, and meals for two people. Includes one Flip Video MinoHD™ and two aluminum canteens. Approximate retail value: $4,500.

Trip is subject to availability and other restrictions. Winner and guest must be able to travel. If winner is unavailable at such time, prize will be forfeited in its entirety without compensation of any kind. If a guest does not accompany winner on trip, prize elements will only be awarded in amounts appropriate for actual number of travelers; and, in such event, winner will NOT receive any compensation relative thereto. Winner and guest must travel together on same itinerary as determined by Sponsor in its sole discretion. If guest is a minor, they must travel with his/her parent/legal guardian on trip (i.e., the Grand Prize winner).

Additional Prizes (2) Studio406 custom Flip Video MinoHD™ camcorders to be provided to two winners. Approximate retail value: $199 (does not include shipping); (3) Studio406 custom stainless steel canteens to be provided to eight winners. Approximate retail value: $15.

No substitution or transfer of prize is permitted, but Sponsor reserves the right, at its sole discretion, to substitute advertised prize with another prize of equal value should advertised prize become unavailable for any reason. Limit one prize per family/address/household.

Odds of winning a prize depend on the total number of eligible entries received.

5. GENERAL CONDITIONS: All taxes on prizes and all expenses not specified herein associated with claiming/use/acceptance prize is the sole responsibility of the winner. Grand Prize winners must sign and return an affidavit of eligibility, a liability release, and, where lawful, a publicity release within 14 days of the date specified in notification. Guest(s) of Grand Prize winner (if minor, his/her parent or legal guardian) must sign and return a liability release and where lawful a publicity release prior to the issuance of travel documents. By participating, entrant releases and agrees to hold harmless the State of Montana, its elected and appointed officials, agents, employees, affiliates, prize suppliers, and advertising and promotion agency, and their respective directors, officers, employees, representatives and agents from and against any and all claims, liabilities, demands, causes of action, and judgments (including the cost of defense and reasonable attorney fees) for any injuries, losses or damages of any kind to persons and/or property arising from acceptance, possession, use/misuse of any prize or participation in this Sweepstakes. By accepting prize, where legal, winner grants to Sponsor the right to use the winner's name, picture, voice, likeness and biographical information for advertising/promotional/trade purposes, and any and all rights to such use, without additional consideration. Any litigation concerning this sweepstakes must be brought in the First Judicial District in and for the County of Lewis and Clark, State of Montana, and each party shall pay its own costs and attorney fees.

LIMITATIONS OF LIABILITY: Sponsor is not responsible for any incorrect or inaccurate information, whether caused by web site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Sweepstakes. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PARTICIPANT MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW. Any use of robotic, automatic, macro, programmed or like on-line entry methods will void all such entries by such methods, and result in disqualification of any entrant using such methods. Sponsor is not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the web site. If, for any reason, the on-line component of the Sweepstakes is not capable of running as planned by reason of, but not limited to, infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which Sponsor, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of the on-line component of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, modify or suspend the on-line component of the Sweepstakes and select the winners in a drawing from all eligible event and mail-in entries received and all eligible on-line entries received prior to and/or after (as appropriate) the action taken by Sponsor.
